Webinar on International Commercial Arbitration
The law department of trinity institute of professional studies, Dwarka organized a webinar on International Commercial Arbitration on 19th December, 2020. The webinar meeting started at 2:00 Pm and was attended by the students of law department. The meeting started with the welcome note by the anchor inviting Dr.Barkha Bahl, Director, TIPS to address the gathering. Afterwards, the webinar started with the lightful discussion by Mr.Harjot Singh, Solicitor, Supreme Court of England and Wales on a very interesting topic “International Commercial Arbitrator”.
The topic begins with the briefing about what exactly International Commercial Arbitrator is, and how the procedure of the arbitration takes place. He explained that International Commercial Arbitration is a part of alternative method of resolving the disputes between private parties arising out of commercial transactions conducted across national boundaries. He explained treaties and convention like 1923 Geneva Protocol on Arbitration, 1927 Geneva Convention on the execution of foreign arbitral which deals with the enforcement of foreign awards, New York convention 1958 deals with the recognition and enforcement of foreign Arbitral Awards. He discussed that there shall be arbitration agreements which concluded for the purpose of setting disputes arising from international trade between nations and private parties. He also explained about the Paris agreement where it shall be ratified or accepted or deposited with the secretary-General of the council of Europe. Later, he discusses the relevancy of international arbitration in context on Arbitration and conciliation act, 1996 where certain rules are set for the enforcement of foreign awards. He also stated that some of the recent cases, Sulamérica CIA. Nacional De Seguros S.A. and Anors v EnesaEngenharia S.A. – ENESA and Anors [2012] EWHC 42 (Comm) and Abuja International Hotels Limited v Meridien SAS [2012] EWHC 87 (Comm), the court heard argument in two very different contexts on the law governing the parties’ agreement to arbitrate, but delivered judgments affirming the same principle deals with laws closely connected to the matter. The doctrine of severability means that, when called upon to ascertain the proper law of an agreement to arbitrate, national courts will undertake a conflicts analysis which is separate from that undertaken in respect of the parent contract. The difference lies in what is now said to indicate the closest system of law to the arbitration agreement with this he concluded his whole discussion. Then, the anchor asked everyone to drop their queries regarding this lightful discussion which was well answered by the chief guest. The webinar concluded with the vote of thanks by Dr.Shashi Bala, Principal, Law Department.
